Firm prevails on MSJ - Thursday, October 15, 2009 - 174 Views

On October 15, 2009, Shivani Sutaria and Gregory L. Spallas prevailed on a Motion for Summary Judgment and obtained dismissal of a lawsuit against a firm client in which the plaintiff alleged sexual orientation discrimination and retaliation.  The case, venued in the United States District Court, District of Nevada, included claims for front and back pay, emotional distress and punitive damages.  The court agreed with the arguments in the Motion that plaintiff was lawfully terminated for reasons which did not involve his sexual orientation and that he did not engage in a legally recognized protected activity for which he was subjected to retaliation.  Brenda E. Entzminger, partner in the firm’s Las Vegas office, argued the Motion before United States District Court Judge Phillip M. Pro.
